Polly Terms of Service

Introduction

The terms "we," "us," or "our" refer to Logopedics Ltd ("the Company"), which owns and operates the Polly Platform. References to "Polly" or the "Polly Platform" include both the web portal and the mobile application unless specifically noted.

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and us. By accessing or using the Polly Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the Polly Platform.

1. Licensing

We grant you a temporary, non-exclusive, non-transferable, and revocable license to access and use the Polly Platform for providing, receiving, or managing speech and language therapy.

Restrictions

You may not:

  1. Redistribute, sublicense, or lend your license to another party.
  2. Reverse-engineer, decompile, or disassemble any part of the Polly Platform.
  3. Claim ownership over any intellectual property belonging to the Company.

Subscription and Fees

  • Subscriptions are billed monthly based on the selected tier and automatically renew unless cancelled.
  • Subscription fees may be adjusted with 30 days' notice.
  • Additional charges or credits may occur due to subscription changes.
  • Stripe is used as our payment processor.

Taxes

Applicable taxes, including VAT, will be added based on your location and are your responsibility.

Cancellation

  • You may cancel your subscription at any time. Access will remain until the end of the current billing period.
  • Refunds for unused subscription periods are not available.

Termination of License

We reserve the right to revoke your license and terminate your access to the Polly Platform for violations of these Terms or other misuse at our sole discretion.

2. Accounts

To use the Polly Platform, you must create an account. You are responsible for maintaining the confidentiality of your credentials and preventing unauthorized access.

User Responsibilities

  1. Use a secure password and keep it confidential.
  2. Limit the number of devices logged into your account.
  3. Notify us immediately of any unauthorized access.

Account Termination

We reserve the right to edit, deactivate, or delete accounts that:

  1. Violate these Terms.
  2. Use inappropriate usernames or content.
  3. Engage in fraudulent or malicious activity.

If your account is terminated, you are prohibited from creating a new account without prior authorization.

  • Polly does not share your personal data with third parties beyond those outlined in the Privacy Policy.
  • External links provided on the Polly Platform are not managed or endorsed by us, and we are not liable for their content or consequences.

All content, software, graphics, and trademarks on the Polly Platform are the exclusive property of Logopedics Ltd unless explicitly stated otherwise. By using the Polly Platform, you acknowledge that:

  1. You have no rights to our intellectual property.
  2. Any unauthorized use may result in legal action.

5. Disclaimers

The Polly Platform is provided "as is" and "as available." We disclaim all warranties, express or implied, including but not limited to:

  1. Accuracy or completeness of content.
  2. Availability of the platform.
  3. Any bugs, viruses, or security breaches.
  4. Fitness for a particular purpose.

We are not liable for any direct or indirect damages, including but not limited to:

  1. Loss of data, revenue, or clients.
  2. Personal injury or property damage resulting from platform use.

6. Modifications

We reserve the right to update these Terms or modify the Polly Platform, including pricing and features, at any time. Changes will take effect upon posting on our website. Significant updates will be communicated through email or in-app notifications.

By continuing to use the Polly Platform after updates, you agree to the revised Terms.

7. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

8. Dispute Resolution

Any disputes arising out of or relating to these Terms, including their breach, termination, or validity, shall be resolved exclusively by arbitration administered by the Chartered Institute of Arbitrators (CIArb) in accordance with its Arbitration Rules. The arbitration shall take place in Leeds United Kingdom, and the proceedings shall be conducted in English. The decision of the arbitrator(s) shall be final and binding on both parties. You agree to waive the right to bring or participate in class action lawsuits in relation to these Terms.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
